Appeal

If you have attended court and feel that things went badly wrong because the Judge or Magistrates did not do things properly, there MAY be a chance to appeal the hearing. Fact Finding Hearing

When allegations of abuse have been made, which is all too common in Children Cases, the court has to make a decision as to hold a hearing to examine the evidence to verify whether the abuse took place or not. Enforcement

When an existing court order is not followed, there are two ways to deal with it, both of which Simon will discuss.  If the better option is to apply for Enforcement, an application needs to be made together with a statement setting out the breaches, costs lost and what you want the court to do about the breach. At the first hearing it is common for excuses to be put forward by the parent that has breached the order and the court will either deal with the breaches at that point, or go to a second hearing having perhaps had the situation investigated.

Witness (Narrative) Statement

The court will order you to produce a statement to explain your situation and to be used in a final hearing

This type of statement will be ordered by the court and is necessary for commenting on allegations, reports or your goals for a final hearing. They need to explain the important aspects of your case, and include evidence that supports your case. You may need to rebut information used against you in court and documents already filed with the court. This is your opportunity to argue your case and fight your corner.

Non-Molestation Order

A Non-Molestation Order, and/or an Occupation Order can be made in your absence and needs to be dealt with and not ignored.

Unfortunately, for a number of reasons, allegations of abuse are made by one party in court proceedings, and the court often needs to provide protection to that party just in case the allegations are true. Having made an order, often in your absence, you then have an opportunity to defend yourself.  You will be provided with the application and evidence against you, and there are a variety of ways that you can deal with them.
